Successful obtainment of mining concessions for extraction of minerals as well as other activities specified in Geological and Mining Law of 2011th , depends i.a. on specific clauses included in spatial planning documents prepared by municipalities. These documents are created; at least in theory; within a consistent spatial planning system and include legislation introduced by the government agencies. This article identifies circumstances when parliamentary and governmental spatial planning legislation influences mining viability and their overall effectiveness. It also analysis regulations which require municipalities to present mineral deposits in spatial planning documents and their implications on the process of acquiring mining concessions. Lastly, this article discusses main challenges of investigation of spatial planning documents, zoning regulations and property uses captured in the master plan with a view of subsequent mining concession obtainment.
